USE OF WEBSITE AND PARTICIPATION IN GIFT REWARD PROMOTIONAL CONTEST
TERMS AND CONDITIONS

These Terms govern your use of the Website, content provided therein and your participation in a {host} Gift Reward Promotional Contest offered to you through the Website (the “Contest(s)”).

{host} (the ‘Website), is the owner and operator of Gift Card Survey and of any and all its domains, (hereinafter referred to as the “Website”) and of all Contests available therein, wishing to offer gift rewards to lucky Users who participate in the Contests.

You (hereinafter refer to as the “User”, “You”, “Yours”, etc.), are a User accessing the Website seeking to participate in a Contest and to win a gift reward.

BY CHECKING THE BOX AND CLICKING “I ACCEPT” BUTTON, AS APPLICABLE, OR BY USING AND/OR CONTINUING TO USE THE WEBSITE AND/OR PARTICIPATING IN A CONTEST FOLLOWING OUR PUBLICATION OF THE REVISED VERSION OF THESE TERMS ON OUR WEBSITE, YOU (A) CONFIRM THAT YOU ARE AWARE AND COMPLY WITH THE PRESENT TERMS AND AGREE TO BE BOUND BY THEM AND OUR PRIVACY POLICY PUBLISHED AT THE WEBSITE; (B) ACKNOWLEDGE AND AGREE THAT YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF PARTICIPATING IN A CONTEST AND ARE NOT RELYING ON ANY REPRESENTATION, GUARANTEE, OR STATEMENT OTHER THAN AS EXPRESSLY SET FORTH IN THESE TERMS AND CONDITIONS; (C) HEREBY REPRESENT AND WARRANT THAT YOU ARE DULLY AUTHORIZED SIGNATORY AND HAVE FULL LEGAL CAPACITY AND AUTHORITY TO ENTER INTO THESE TERMS AND CONDITIONS AND THAT YOU ARE AND WILL REMAIN IN COMPLIANCE WITH THESE TERMS AND CONDITIONS AND THAT YOU SATISFY ALL USER’S CONDITIONS AND REQUIREMENTS PROVIDED HEREIN AT ALL TIMES; (D) AGREE TO RECEIVE DIRECTLY TO YOUR PHONE NUMBER AND/OR E-MAIL NEWSLETTERS, TRAFFIC MONETIZATION INSIGHTS, LATEST PROMOTIONS, CASE-STUDIES AND TUTORIALS FROM US; (E) AGREE TO THE TRANSFER OF YOUR DATA TO OUR PARTNERS TO CONTACT YOU FOR THE PROMOTION AND MARKETING OF THEIR PRODUCTS AND SERVICES.

• Participation in a Contest

Use of the Website and participation to a Contest is free of charge. To apply for your participation in a Contest you must finalize ALL the below steps:

• complete our survey within the set timeframe; and
• find a gift amongst the gift boxes within three (3) attempts; and
• register online at any time before the Contest Date (as per the Website)

For your registration to be accepted/qualified and in order to enable your participation in a Contest, you must meet all the following criteria:

• You must be eighteen (18) years old or older;
• You must have registered only once by using one (1) email only for each Contest. Registering more than once and/or using more than one (1) email is strictly prohibited and will automatically disqualify you from a Contest.

Users who do not meet both the above criteria will not be accepted/qualified to participate in a Contest and will not have the chance to win a gift reward.
{host} is entitled to reject applications to participate at any time and at its own discretion without further explanation or prior notice.
Gift rewards are not fixed and may differ according to each Contest and each User’s location. Our gift rewards are mainly promotional gift cards to online/offline stores.

• Obligations of Contests Winners

Each accepted/qualified User participating in a Contest is offered the chance to win only one gift reward per Contest.
Contest winners will be randomly selected through an online raffle/lot which will take place on the Contest Date (as per the Website).
You hereby understand that access to a Contest requires compatible devices, and certain software (including third party software) may need updates, and your access to a Contest may be affected by the performance of these elements. You must have a high speed internet connection in order to access a Contest. When accessing a Contest through a mobile network, your network or roaming network may apply fees for data usage.
Contests winners will be personally contacted by us and/or by our third party service providers via email in relation to their winning and gift reward.
We reserve the right to publicly announce/publish any information about the Contests winners, including their name, email, etc on our Website and social media channels including but not limited to Telegram, Instagram, YouTube, Twitter, etc.
Contests winners must, within thirty (30) calendar days since the first communication email to them, reply through their registered email to arrange for the delivery of their gift reward. The Contests winners hereby understand, agree and expressly release {host} and our third party service providers from any and all liability in any case they do not contact and/or do not reply and/or cannot be contacted by us and/or our third party service providers for any reason within the thirty (30) calendar days’ time limit.

• User Representations and Warranties

You hereby represent and warrant the following:

• You give {host} an irrevocable non-exclusive right to use your email, name, phone number and any other personal information provided by you under these Terms for the purposes governed by these Terms and Conditions, including for the use of the Website and/or content and/or participation in a Contest and/or for the announcing/publication of your personal data in case you are a Contest winner.
• You give {host} an irrevocable non-exclusive right to transfer to its partners and third party service providers your email, name, phone number and any other personal information provided by you under these Terms for the purposes of executing these Terms and Conditions and/or for contacting you for the promotion and marketing of their products and services
• You will promptly respond to all communications, in no event later than within 48 hours, whether in text, email, phone or any other form.
• You will notify us promptly of any changes to your email or of any other information submitted by you.
• As a winner you will forfeit your right to the gift reward if you cannot be reached at the email address given by you within thirty (30) calendar days, if you do not contact us and/or our third party providers within thirty (30) calendar days of notification of your winning/gift reward or notification of your gift reward cannot be delivered.
• You and/or your Brand is not involved in any illegal activities and/or in any advertising or marketing practices that are deceptive, misleading or fraudulent.
• You will act in a legal, ethical manner and maintain the highest degree of professionalism and standards of integrity, honesty and responsibility in your dealings with {host}
• You will not act in an unlawful, harmful, threatening, defamatory, offensive, harassing manner or in other similar way that may disrepute and/or harm the name, goodwill and reputation of {host} and/or its services and/or Website and/or content and/or a Contest.
• You will not interfere with and/or manipulate the process of a Contest in any way, especially technical processes, or attempt to do so and/or try in any other way to influence the draw of a Contest.
• You will not engage in any action liable to impair the smooth operation of our Website(s), Contest(s) and/or to overload our systems.
• You will not engage in any activity that may harm in any way the Website, any Contest, its participants and/or other participants.
• You will not interfere in any way with the Website, any Contest and/or with the provision of the gift rewards under these Terms.
• You will not engage in any activity that violates or breaches {host} or any third party’s legal rights.
• You will not make any defamatory remarks and/or any untrue statements or claims about or on behalf of {host}
• You will not use {host} Website and/or content and/or any Contest for or in connection with commercial purposes. These are only intended for your non-commercial use. Prohibited commercial use includes in particular:
• any offer or advertising of paid content, services and/or products, both your own and those belonging to third parties,
• any offer, advertising or execution of activities with a commercial background such as sweepstakes, draws, barters, adverts or pyramid schemes, and
• any electronic or other gathering of identity data and/or contact details (including email addresses) belonging to members (e.g. for the dispatch of unsolicited emails).
• You will not receive any monetary payment under these Terms and/or any Contest.
• There can be no recourse to legal action and gift rewards cannot be paid out in cash.
• Any and all gift rewards under these Terms are provided as is and your hereby release us from any responsibility in relation to their functionality, dysfunctionality, malfunction, etc and you hereby indemnify us against any and all legal actions in connection to the said gift rewards.
• You are solely and fully responsible for any and all taxes in relation to the gift rewards.
• If, at any time before the online raffle/lot, you are in breach of these Terms and Conditions we may at our own discretion immediately disqualify you from any Contest.
• In any case you stop and/or no longer meet the participation/registration criteria described in clause 1. above, at the sole discretion of {host}, at any time and for any reason, you will no longer be accepted/qualified to participate in any Contest nor to have the chance to win any gift reward.
• You are strictly restricted to attempt to host or organise any Contest in conjunction with, contiguous to or purporting to be related to any Contest or its participants without the express prior permission and cooperation of {host}. We reserve their right to take such action (legal or otherwise), including a claim for damages as we, in our sole discretion, deem appropriate in the circumstances.

In any case you are in breach of any representation and warranty, as also, of any other term of these Terms and Conditions, we reserve the right to refuse your use of the Website and/or content and/or participation into and/or to disqualify you from any Contest, at any time without explanation nor prior warning or notification

• Rights of Use

All copyrights and rights of use to {host}’s Website and/or content provided therein (text, graphics, etc.) and/or Contests are expressly reserved.
Unless any further use is explicitly permitted in these Terms and Conditions or on our Website,

• you may only retrieve and display the content available on the Website for personal purposes. This right of use is limited to the duration of your contractual participation,
• you may not process, change, translate, present, publish, exhibit, duplicate or distribute in any other way the content available on the Website and/or on the Contests either in whole or in part. You are also forbidden from removing or altering copyright notices, logos or other markings or proprietary notice.

Any forbidden exploitation, distribution, duplication or other breach of commercial property rights and copyrights will be pursued in the civil and criminal courts.

• Limitation of Liability

We always endeavours to keep our Website and Contest(s) fully functional, but temporary restrictions or interruptions cannot be ruled out as a result of technical malfunctions (e.g. interruptions to the power supply, hardware or software errors, and technical problems in data lines).
We reserve the right to shut down, restrict or change the operation of our Website and/or of any Contest wholly or partially, at any time and for any reason, without explanation or prior notice.
We reserve the right, at our sole discretion, to either modify or discontinue the email newsletter, traffic monetization insights, latest promotions, case-studies and tutorial content, at any time with or without notice. We will not be liable to you or any third party should we exercise such right. • Warranty

EXCEPT FOR THE EXPRESS WARRANTIES SET FORTH IN THESE TERMS AND TO THE EXTEND PERMITTED BY LAW {host} EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES FOR NON-INFRINGEMENT, SATISFACTORY QUALITY, MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR PURPOSE. TO THE FULLEST EXTENT PERMITTED BY LAW, ANY AND ALL CONTEST(S) AND GIFT REWARD(S) IS(ARE) PROVIDED “AS IS” AND AT USER’S OPTION AND RISK AND {host} DOES NOT GUARANTEE ANY WINNING, GIFT, REWARD, RESULTS OR SECURITY OF ANY KIND.
YOU ASSUME ALL RESPONSIBILITY AND RISK FOR USE OF THE WEBSITE, CONTENT, CONTESTS, GIFT REWARDS AND YOUR PARTICIPATION IN ANY AND EVERY CONTEST. These Terms and Conditions shall be governed by and construed in accordance with the laws of Cyprus. The courts of Cyprus shall have exclusive jurisdiction over any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms or their subject matter or formation.
These Terms and Conditions enter into force upon your use of the Website and/or its content and/or your participation and registration in a Contest and/or otherwise upon your explicit acceptance of these Terms through any action, and shall remain in force as long as you make use of the Website and/or its content and/or any Contest therein.

These Terms are non-exclusive and the relationship between the Parties is that of an independent contractors. Nothing contained in these Terms shall be deemed to create any association, partnership, joint venture, or relationship of principal and agent or employer and employee between the Parties.
The invalidity, illegality or unenforceability of any provision of these Terms shall not affect the validity or enforceability of any other provision hereof, and these Term and Conditions shall be construed as if such invalid, illegal or unenforceable provision had not been contained herein.

All notices given under these Terms shall be sent to you by email to the email address submitted by you when registering for a Contest. Notice shall be deemed served at the date of automatic delivery receipt. You acknowledge and agree that entering into these Terms, you have not relied and you are not relying on any representations, warranties or other statements whatsoever, whether written or oral other than those expressly set out in these Terms and Conditions, Privacy Policy or other terms and conditions published at our Website and that you will not have any right or remedy rising out of any representation, warranty or other statement not expressly set out in these Terms.
